Kelly leveraged his early experience in the oil patch and construction estimating into a diverse legal career stateside and overseas. Most recently, as General Counsel for a large water/wastewater utility under USEPA directed Court Order, he was responsible for a complete overhaul of the contract and Improvement Project procurement regime that completed over $450MM in construction of treatment and transmission. He was also primary counsel in negotiations with USEPA toward a 25-year compliance decree to address alleged Clean Water Act violations. To fund all of these capital improvement projects Kelly was also involved in the rating, pricing and marketing of over $250MM in municipal bonds and refunding of existing securities.
Kelly’s litigation experience includes utility rates, a $70MM contract/warranty/deceptive trade practices case against one of the largest water meter manufacturers in North America. Kelly has also been involved in large eminent domain litigation as well as personal injury, construction, firearms, maritime/admiralty administrative appeals and election fraud.
As the chief legal and operating officer of one of the first hydro-excavation contractors in the US, Kelly managed a specialized and innovative company providing services to the electric and water utility construction industries as well as the E & P, midstream and refining segments of the oil and gas industry, Kelly managed business development risk management, licensing, and compliance with OSHA, State and Federal DOL, USDOT, TXRRC, and FMCSA.
Kelly is admitted to practice in Wyoming, Colorado and the Territory of Guam, the Federal District Courts of Colorado and Guam and a member of the 9th Judicial District and Northwest Colorado Bar Associations.
